Case A

Supplier Breach — Distribution Agreement

Challenge

A Bangkok-based distributor faced a situation where a supplier had failed to deliver contracted goods over three consecutive quarters, causing downstream losses to the distributor's own customers. The distributor was uncertain whether the contract provided a viable claim and whether the loss quantum was provable in court.

Approach

A Pre-Action Memorandum was commissioned first, which concluded that the breach was clear on the contract terms and that damages were quantifiable from available records. First-instance proceedings were filed in the Civil Court. Witness statements from the distributor's operations team provided the factual foundation for the damages claim.

Outcome

The matter resolved by settlement midway through the first-instance proceedings, with the supplier agreeing to pay a sum that covered the majority of the claimed losses. The client noted that the written reports throughout the proceedings had allowed their management to remain informed without needing to attend every hearing themselves.

Case B

Cross-Border Joint Venture Dispute

Challenge

A foreign company with a joint venture in Thailand faced a breakdown of the relationship with its Thai partner, with allegations of improper asset transfer and breach of the joint venture agreement. Parallel advisory proceedings were underway in the foreign company's home jurisdiction, and evidence was held in both countries.

Approach

The Substantial Litigation Programme was engaged. Luxauct Counsel coordinated closely with the client's overseas counsel on the strategy for Thai proceedings and managed the process of obtaining and presenting cross-border evidence through the mechanisms available under Thai civil procedure. Quarterly reports kept the client's board informed throughout.

The matter was resolved through a coordinated settlement covering both jurisdictions, following a period of structured settlement discussions that ran alongside the Thai proceedings. The client noted that the coordination between Bangkok and their overseas counsel had been the key factor in reaching a consistent settlement position.

Case C

IP Dispute — Central IP Court

Challenge

A technology company discovered that a former licensee was continuing to use licensed software after the licence agreement had been lawfully terminated. The company sought advice on whether the Central Intellectual Property and International Trade Court was the appropriate forum and whether a pre-action injunction application was feasible.

Approach

The Pre-Action Memorandum addressed the jurisdictional question directly and assessed the feasibility of an injunction application before proceedings were filed. On the basis of that assessment, the company filed in the Central IP Court. A temporary injunction was sought at the early stages of proceedings and the case proceeded through the hearing stage.

Outcome

The court granted the injunction application and the matter proceeded to a judgment that confirmed the termination of the licence and prohibited continued use. The client noted that the familiarity of counsel with the IP Court's specific procedural requirements had made the process considerably more straightforward than anticipated.
