Who We Are

Luxauct Counsel

Luxauct Counsel is a commercial litigation practice based in Bangkok, operating from Sathorn Road — a location chosen for its proximity to the Civil Court and the Central Intellectual Property and International Trade Court.

The practice was founded on a straightforward premise: companies involved in commercial disputes deserve counsel that is honest about the likely course of proceedings, transparent about cost, and methodical in its preparation of the case. The Thai court system is demanding in its procedural requirements, and experience working within its structure is a significant practical advantage.

We work with companies of varying size — from Thai businesses managing a single disputed contract through to international groups running substantial proceedings in Thailand alongside parallel matters in other jurisdictions. Our three service formats are designed to reflect these different circumstances clearly.

The practice places particular weight on written communication. Clients receive a written account at each stage of their matter, so the position of the case is documented and clear at all times.

How We Work

Every matter begins with an assessment. Before we recommend proceedings, we examine the dispute from the perspective of the contract, the breach, the available remedies, and the practical considerations of Thai civil procedure. Where mediation or a negotiated resolution is feasible, we say so.

When litigation proceeds, we manage the work in a steady, organised manner — preparing pleadings and documents with care, attending hearings with preparation, and keeping clients informed throughout. We do not use alarming language about outcomes, and we do not overstate the strength of a position.

For matters with cross-border elements, we coordinate with overseas counsel to ensure that the Thai proceedings are managed consistently with what is happening elsewhere, and that evidence and argument are aligned across jurisdictions.

Commercial Litigation in Thailand

Commercial disputes in Thailand pass through a structured court hierarchy. First-instance civil matters are heard in the Civil Court, located in Bangkok's central court complex. The Court of Appeal sits above the Civil Court, and the Supreme Court — the Dika Court — is the court of final determination on questions of law. For disputes involving intellectual property, international trade, or technology matters, the Central Intellectual Property and International Trade Court provides a specialist forum with experience in cross-border commercial cases.

Proceedings in these courts follow the Civil Procedure Code, which sets out detailed rules on pleadings, evidence, witness examination, and the conduct of hearings. Compliance with these procedural requirements is non-negotiable, and well-prepared documentation and witness statements are a significant factor in how a case proceeds through the hearing stages.
