What is a Pre-Action Strategy Memorandum?
It is a written assessment prepared before any court proceedings are issued. It examines the contract at the centre of the dispute, the nature of the alleged breach, what remedies are available under Thai law, and what the procedural route through the courts would look like. It also includes a note on whether mediation or another alternative pathway might be more appropriate than litigation.
Which courts in Thailand handle commercial disputes?
Most commercial matters are filed in the Civil Court at first instance, with appeal lying to the Court of Appeal and then the Supreme Court. Where the dispute involves intellectual property, international trade, or certain technology matters, the Central Intellectual Property and International Trade Court in Bangkok has jurisdiction. The appropriate court depends on the nature and value of the claim, and we advise on that as part of our initial assessment.
How long does commercial litigation in Thailand typically take?
The duration varies considerably. A straightforward first-instance matter might conclude within one to two years. More substantial cases, particularly those involving cross-border evidence or complex factual disputes, can extend beyond that. Appeal proceedings add further time. We provide a considered estimate as part of the Pre-Action Strategy Memorandum, based on the particular circumstances of the dispute.
What are your fees and how are they structured?
Our three service engagements carry stated fees: ฿4,400 for a Pre-Action Strategy Memorandum, ฿24,400 for First-Instance Court Representation in a mid-sized dispute, and ฿39,000 for a Substantial Litigation Programme. These are the engagement fees; disbursements such as court filing fees are separate. We discuss the full cost picture during an initial consultation.
Can you assist if the dispute has a cross-border element?
Yes. The Substantial Litigation Programme is designed specifically for disputes that involve foreign parties, overseas evidence, or proceedings running in parallel in another jurisdiction. We coordinate with overseas counsel as needed and ensure that the Thai proceedings are managed with full awareness of developments elsewhere.
Is mediation considered as an alternative to litigation?
It is considered in every engagement. The Pre-Action Memorandum includes a section examining whether mediation, negotiation, or another form of alternative dispute resolution might serve the client's interests as well as or better than proceedings. Luxauct Counsel does not encourage litigation where a more practical resolution is within reach.
